TERMS & CONDITIONS

Effective from the 1st of January, 2021

We have put these wedding photography & videography Terms and Conditions together so as to answer some of your frequently asked questions and prevent potential logistic difficulties from happening.

Definitions & Acceptance

“The Photographer” is referring to YORGE (Yorge Kucik). “The Client” is referring to the couple with whom the Photographer enters into a contract for the sale of goods or provision of services.

All purchase orders and transactions between the Photographer and the Client, whether made orally or in writing, are subject to these wedding photography and videography Terms & Conditions which shall be deemed to be incorporated into any contract between the Photographer and the Client.

Retainer fee, payment schedule & delivery

A retainer fee is required to reserve the dates and times of the wedding. If the wedding is rescheduled, postponed, or cancelled; or if there is a breach of contract by the Client, the retainer fee is non-refundable and shall be liquidated damages to the Photographer.

In the unlikely event that the Photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the Photographer, the Photographer will make every effort to secure a replacement.

If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the wedding.

The aforementioned non-refundable retainer fee is due at the time of signing of the purchase order. The remaining balance is payable in full immediately after the wedding.

The Photographer is not liable to deliver every image taken at the event. The determination of images delivered to the Client is left to the discretion of the Photographer. The average time of delivery is 1-2 months.

Films & Copyrights

The photographs produced by the Photographer are protected (all rights reserved). The Photographer grants the Client permission to share the wedding images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the Photographer.

The Client must obtain a written permission from the Photographer if they decide to use their work for any marketing purposes or selling the photographs. Violation of this rule will be a trespass of counterfeiting, meaning of Czech Act no. 121/2000 Coll., on Copyright and Related rights, as amended

Expenses incurred

When applicable, the Client is responsible for travel & accommodation costs unless provided by the Client.

In many cases, it is necessary that the Photographer arrives the day before the wedding in order to avoid any traffic complications.

The client is obliged to provide refreshments for the photographer at the wedding (a lunch and dinner at the wedding venue are sufficient).

Entrance fees & permits

If an entrance fee or permit is required to enter the locations requested by the Client, it is the Client's duty to secure all such permits or entrance fees for the Photographer. Otherwise, the photographer bears no responsibility for lost time. Costs associated with entrance fees etc. are paid by the Client.

Parking

If parking at the wedding venue is complicated or requires a permit, it is in the interest of the Client to reserve, reserve or arrange a permit for a parking space for the Photographer. The photographer is not responsible for lost time caused by parking complications. The costs associated with parking are covered by the Client.

Other photographers

We reserve the right to be the only photographer at your wedding. Second shooters are possible only by prior arrangement.

Event schedule

The Client agrees to notify the Photographer of any important changes in the wedding schedule or locations. The Photographer must be made aware of these changes in a timely manner, i.e. at least a week prior to the wedding. Please note that the time spent moving from one wedding location to another counts towards the booked coverage.

Limitation of liability

The Photographer is not responsible for lost time or reduced quality of images due to reasons beyond their control. These reasons include: obstacles posed by wedding guests, dark ceremony halls and churches, entry restrictions, unaesthetic environments , wedding suit or dress defects, waiting for late guests and suppliers, bad lighting conditions, bad weather, providing the wrong address of the venue and, among other things, wedding guests shooting with their phones in front of the photographer.

The client acknowledges that every person is different, has their own unique appearance, and that the aesthetic quality of the photos therefore varies. Client's dissatisfaction with their own appearance is by no means a case for refund.

The Photographer is not obliged to document each wedding guest or deliver all photographs taken at the wedding. If the Client wishes a specific type of photography, or imagery of certain objects/persons, he is obliged to inform the Photographer about it in a timely manner.

In unlikely cases that prevent the Photographer from providing the ordered services, such as injury, illness, or an Act of God (e.g. a traffic accident), or in cases that are beyond the Photographer's control (e.g. loss of digital files due to equipment malfunction, accidental destruction, or theft), any liability or obligations of the Photographer are limited to the return of all payments made by the Client for the ordered services.

Safety

The Photographer reserves to right to terminate coverage and leave the location of the wedding if the Photographer experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the wedding; or in the event that the safety of the photographer is in question.

In case the Photographer was forced to leave the wedding prematurely due to the above-mentioned reasons, he will process the material documented at the wedding, and is under no obligation to financially compensate for this shortened coverage.
